Court of Appeals Says "No" to OSHA's "Vaccine or Test" Emergency Mandate for Employers with 100 or more employees

After imposing a temporary stay on November 6 and expediting briefing of the parties, on Friday, November 12, the U.S. Court of Appeals for the Fifth Circuit issued a permanent order staying enforcement and implementation of the federal Occupational Safety and Health Administration’s (OSHA) COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS), which was scheduled to begin requiring compliance on December 5, 2021
