Truckers Lose Independent Contractor Exemption in California

California Assembly Bill 5 (AB5) went into effect on January 1, 2020. It requires companies that hire independent contractors to classify them as employees. Under AB5, companies must use the three-pronged “ABC Test” to determine whether workers are considered independent contractors or employees.

Study Shows Tort Reform Benefits

A recent study conducted by Citizens Against Lawsuit Abuse (“CALA”) found that tort reform legislation could save California residents and businesses nearly $23 billion. The study also concluded that savings from tort reform could then be utilized to support more than 206,000 new jobs and generate over $46 billion in increased economic activity.

Featured Settlement : Auto Accident

On December 8, 2020, defendant City of Redondo Beach agreed to the terms of a $4.6 million settlement associated with an accident involving a motorcycle and automobile on Pacific Coast Highway in Redondo Beach. Plaintiff Connor Cassidy was riding a motorcycle on the northbound side of PCH when he struck a vehicle driven by defendant Kenneth Myers resulting in catastrophic injuries to plaintiff including traumatic brain injury, multiple broken bones, and memory loss.
