The Supreme Court’s Decision Not to Hear Challenge to AB 5 Met With Trucker Protest

The U.S. Supreme Court declined to review a Ninth Circuit decision holding that California’s Assembly Bill 5 (“AB 5”), which effectively would classify independent contractor truck drivers as employees of motor carriers, was not preempted by federal law. As a result, AB 5 can now be enforced against motor carriers.

On August 23, 2021 the City of Burlingame agreed to the terms of a $35 million settlement to resolve the claims brought by Raymond Wu, who suffered a spinal injury and the estate of Bena Chiwa NG, who was fatally injured when a tree branch from an Atlas Cedar Tree struck them during a picnic on Sept, 6, 2020.
