Featured Truck V. Auto Verdict

Jesse Equihua, et al. v. Marilyn Chausse, et al. (Los Angeles Super Ct. No. 19AVCV00071): On August 18, 2021 a jury entered a verdict of $141 million after a default prove-up hearing in favor of Plaintiff Jesse Equihua. Plaintiff, a 58 year old truck driver was t-boned by an automobile being driven by defendant Shayna Nash, while plaintiff was attempting to proceed through an intersection in Lancaster. The force of the impact caused plaintiff’s truck to roll over, resulting in catastrophic personal injuries including traumatic brain injury, and herniation of multiple vertebrae. Plaintiff’s injuries were so severe that he will need future treatment including three corrective spine surgeries, implantation of a neurostimulator and lifetime of care due to the traumatic brain injury. Defendant’s untimely answer to the complaint was struck by the court and precluded from being introduced as evidence, which resulted in the initial default judgment.
