$20.7 Million Verdict Awarded in Premises Liability Case After Pedestrian Injured by Falling Construction Material
Vanessa Oliveira v. Mariott International, Inc., et al (San Francisco Super Ct No. CGC-21-595848): After 17 days of deliberation, a jury awarded a verdict of $20.7 million to Plaintiff Vannessa Oliveira, who suffered a traumatic brain injury after she was struck in the head by a stud that fell from a scaffolding outside of the Mariott hotel. Plaintiff sued the hotel and contractors Scaffold Solutions, Skanska USA Building and David Schmidt Construction alleging that they had acted negligently in failing to protect the public from falling construction material. In rendering their verdict, the jury assigned 75 percent liability to Skanska, 10 percent to Scaffold Solutions and 10 percent to remaining defendants. Plaintiff was represented by Feher Law APC and Compass Law Group LLP.
