Monsanto Obtains Another Verdict Reduction in Roundup Cases
San Diego County Superior Court Judge Kevin Enright reduced a recent $332 million verdict against Monsanto to $28 million, finding that the punitive damages award of $325 million was unconstitutional and lacked a reasonable relationship to the $7 million in compensatory damages. The punitive damages amount was reduced to $21 million. The verdict related to the popular weed-killing product Roundup.
This reduction follows in the footsteps of other reductions in Roundup cases. In 2018, a San Franscisco County Superior Court judge reduced a $289 million award to $20.6 million. In 2019, an $80 million award was reduced to $25.27 million by a United States District Court judge. Also in 2019, an Alameda County Superior Court judge reduced a massive $2 billion award to $86.7 million.
Monsanto has not, however, been entirely successful at obtaining reductions in all venues. A Philadelphia Court of Common Please judge declined to reduce punitive damages in a $175 million award.
