Featured Transportation Verdict: $4M to Family of Minor Skater Struck by Delivery Van
Rodriguez, et al. v. Ulloa, et al. (Orange Co. Super Ct., No. 30-2016-00853728): On March 7, 2018 a $4,000,000 verdict was reached on behalf of Plaintiffs Ubaldo Rodriguez and Rosa Campos, and against defendants Frederick Ulloa and his employer Floral Supply Syndicate. Plaintiff’s minor child, Fernando Rodriguez, 16, was riding a skateboard on Wanda Road in Orange when he was struck and fatally injured by a van being driven by defendant Frederick Ulloa during the course and scope of his employment by Floral Supply Syndicate. Plaintiffs alleged that Ulloa was under the influence of marijuana at the time of the accident when Ulloa negligently swerved and struck Rodriguez, riding in a bike lane at the time. Defendants denied that Ulloa was under the influence of marijuana, and alleged that decedent negligently rode his skateboard in front of Ulloa, directly in front of his van. The jury attributed 85 percent fault to defendants and 15 percent fault to decedent. Plaintiffs were represented by Kalfayan Merjanian LLP. Defendant Ulloa was represented Selman Breitman LLP.
