Poole & Shaffery, LLP has concentrated a wealth of expertise in environmental representation before state and federal courts and regulatory agencies. This necessarily requires an in-depth familiarity with complex regulatory schemes governing environmental protection, familiarity with regulatory boards and the ability to draw experts from many divergent disciplines.

Representation includes the defense of "Fortune 500" companies, to smaller, closely held companies, in litigation and regulatory proceedings, as well as transactions involving state and federal regulation. Our attorneys appear before numerous regulatory boards including the Environmental Protection Agency, the Department of Health Services, Air Quality Management Control Districts and the Department of Toxic Substance Control.

Our experience encompasses massive federal cost recovery "superfund" actions, private party cost recovery actions (CERCLA, state common law and statute), hazardous waste (RCRA) actions, underground storage tank cleanup and reimbursement actions, complex Clean Water Act litigation, FIFRA actions concerning allegedly defective pesticides and issues arising under Proposition 65.

Environmental issues often involve toxic tort exposure issues involving a host of contaminants, including wastewater treatment of organisms, asbestos, chemicals, metals, latex, lead, wood and pesticides. The desirability of early investigation, immediate containment, and prompt crisis management to mitigate the impact of later regulatory or criminal enforcement cannot be understated.

Because many of these matters are raised in the context of class actions, mass torts and complex litigation, we have developed a system of litigation/claim management which enables us to provide legal representation with a high degree of efficiency. Our systems prevent duplicative and wasted effort, enabling us to obtain the fastest results our proactive defense strategies permit.
